Submission of Notice of Termination (NOT)
Permittees who are presently covered under an EPA-issued NPDES General Construction Permit for storm water discharges that are associated with construction activity may submit an NOT form when:
- Final stabilization has been achieved on all portions of the site for which the permittee is responsible
- Another operator has assumed control in accordance with Appendix G, Section 11.C of the CGP
- Coverage under an alternative NPDES permit has been obtained
- Temporary stabilization has been completed and the property has been transferred to the homeowner (residential construction only).

Notice of termination (NOT) may be prepared and submitted to the EPA by the
permittee when 70 percent of the planned stabilization has been completed.
The following information will be needed to complete the NOT form:
- The existing NPDES permit number assigned to the project by the EPA.
- If this number is not known it may be able to be found at http://cfpub.epa.gov/npdes/stormwater/noi/noisearch.cfm
- The reason for submitting the NOT.
- Operator name, address, telephone number, and Employer Identification Number as established by the U.S. Internal Revenue Service.
- Project/Site name, address, and county or similar governmental subdivision of your construction project or site.
- A certification statement signed and dated by an authorized representative as defined in Appendix G, Section 11 of the CGP and the name and title of that authorized representative.
Record Retention As part of the CGP, the SWPPP and supporting documentation (including eNOI documents) should be retained for a period of three years after the completion of final stabilization of the project. This may protect the permittee from future claims concerning water quality from measures implemented at the site during construction.
